PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

1.A STOCK

  • Out of stock items will have to be ordered in and will, therefore, take longer to deliver. We will notify you by email or telephone if this is the case.

  • Faulty items will be exchanged but it is your responsibility to return them to us. Replacements will only be dispatched upon receipt of the faulty item.

  • Discrepancies with your delivery should be reported to us within two working days of receipt.
Always give a correct e-mail address when placing an order so that we can readily notify you of any problems and keep you in touch with your order progress. It is our policy only to send marketing information to those customers who request it; we will not abuse your e-mail privacy.

1.B PAYMENT

All prices are inclusive of VAT (where applicable) and are correct at the time of entering the information onto our database. The total cost of your order is the price of products ordered plus delivery charges as stated upon the website.

1.C REFUSAL OF TRANSACTION

We reserve the right to withdraw any products from this website at any time. We may refuse to process any transaction for any reason or refuse service to you at our sole discretion.

To be eligible to purchase products on this website and lawfully enter into contracts under English law you must:

  • Register by providing your real name, email address, invoice and delivery address and payment information
  • Be 18 or over years of age
  • Possess a valid credit or debit card

By making an offer to buy a product, you specifically authorise us to transmit information or to obtain information about you from certain third parties specific to financial authorisation including but not limited to your debit or credit card number and credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

As a matter of policy, we will not sell or rent any personally identifiable information about you to any third party.

1.2 No contract exists between you and CS for the sale of any goods until CS has received and accepted your order and sends you confirmation in writing or by email to the address or email address you have given. Once CS does so, there is a binding legal contract between us.

1.3 The contract is subject to your right of cancellation (see below) and CS reserve the right to refuse to accept orders from any individual or company at its absolute discretion.

1.4 CS may change these terms of sale without notice to you in relation to future sales.

2. DESCRIPTION AND PRICE OF THE GOODS

2.1 The description and (subject to clause 2.4) the price of the goods you order will be as shown on CS's current website at the time you place your order.

2.2 All drawings, descriptive matter, specifications contained on CS's website are published or issued for the sole purpose of giving an approximate idea of the goods described in them. They will not form part of this contract.

2.3 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, CS will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.4 Every effort is made to ensure that prices shown on CS website are accurate at the time you place your order. If an error is found, CS will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order. If you cancel, CS will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.5 The price of the goods are inclusive of VAT where applicable.

3. PAYMENT

3.1 Payment for the goods can be made by any method shown on CS's website at the time you place your order.

4. DELIVERY

4.1 The goods you order will be delivered to the address you give when you place your order.

4.2 Every reasonable effort will be made to deliver the goods as soon as possible after your order has been accepted. Any dates specified by CS for delivery of the goods are intended to be an estimate. However, CS will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, CS will inform you as soon as possible.

5. YOUR RIGHT OF CANCELLATION

Under the Consumer Protection Regulations 2000 you have a statutory right to cancel your order and receive a full refund up to and including the 7th day after receipt.

5.1 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to CS at your own cost. The goods must be returned to the address shown at 1.1 above. You must take care to ensure the goods are not damaged in the meantime or in transit.

5.2 If for any reason you decide not to keep an item, you can return it for a refund or replacement. Please advise us within seven working days. Non-faulty items must be returned in their original packaging, where appropriate and must be in an unused condition.

5.3 Once you have notified CS that you are cancelling the contract, CS will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

5.4 If you do not return the goods as required, CS may charge you a sum not exceeding the direct costs of recovering the goods.

5.5 You do not have the right to cancel the goods if the order is for goods which by their nature cannot be returned or are liable to deteriorate once opened.

6. WARRANTY

6.1 If the products CS deliver to you are not as ordered or are damaged, defective or of incorrect quantity, CS's liability shall be limited to replacing the damaged or defective products or making good the shortfall in quantity or at CS's option crediting the price and delivery charges of those products to your credit/debit card. CS'shall not be liable to you for failure to deliver products ordered by you unless you notify CS within 30 days of the date of your order. CS's liability shall be limited to delivering the products ordered or at CS's option crediting the price and delivery charges of the non-delivered products to your credit/debit card.

6.2 CS, its directors, employees and other agents shall not be liable for any direct, indirect, special or consequential loss or damage including loss of profit or any other form of compensation. Nothing in these terms and conditions shall be construed to limit CS's liability for death or personal injury caused by its negligence

6.3 This does not affect your statutory rights.

7. DATA PROTECTION

7.1 CS will take all reasonable precautions to keep the details of your order and payment secure, but unless CS is negligent, CS will not be liable for unauthorised access to information supplied by you.

7.2 CS will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. CS would also like to notify you of different products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please log into your account and specify your preferences.

You can correct any information we hold about you, or ask for information about you to be deleted, either by logging into your account or by giving written notice to CS at the address, telephone number or email address shown at 1.1 above.

8. APPLICABLE LAW

As the internet allows access to the site from countries acting under different laws differing from those of CS (anywhere outside England and Wales ), you agree that insofar as is allowed by any relevant legislation or jurisdiction English Law shall govern this contract and any disputes under it.

9. INTELLECTUAL PROPERTY

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material and content supplied as part of this website shall remain at all times vested in us or our licensors. The Catalina Society hereby contests that all content on this site that is not specifically the property of The Catalina Society is used with and offered to you on this site with full agreed permission from all and any original copyright owners. By visiting this website and offering to purchase products from The Catalina Society you hereby consent to the following condition(s), that:

- You are permitted to use this material only as expressly authorised by The Catalina Society.

- You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only.
